As a result of recent changes to the work test, a technical deficiency was identified, such that, persons who are not common law employees, like directors and politicians, could no longer make personal deductible superannuation contributions.
To fix this, the ATO has issued a draft legislative instrument LI 2023/D11, and explanatory statement, to ensure that such persons can continue to make personal deductible contributions. The legislative instrument is proposed to commence from 1 July 2022.
